My husband and I both signed up for gym memberships in July 2014, for a total of about $1,600. At the time of agreement my husband and I where unsure of signing a three year agreement, but the General Manager insisted that we could have our funds prorated back to us if we decide to cancel.

He ensured that we could cancel at ANY TIME for a refund. We used the membership about three times and the equipment we wanted to use was out of service for one reason or another. Today my husband and I attempted to have our 3 year memberships reduced to a 1 year membership in hopes to get some of our money back. We were told by the Operations Manager that we would not be able to be refunded because of the type of contract we had.

We explained that the General Manager said we could cancel at any time when we signing up for the membership. We were handed a copy of our agreements and were told to contact the corporate office to talk to member services. We contacted member services and the representative read us our agreement. He made it clear that they wont not refund us unless we "become physically unable to use a SUBSTANTIAL PORTION of the club services for 30 or more consecutive days, and your estate may cancel in the event of your death.

You must prove you are unable to use a substantial portion of club services by a doctor's, physician assistant's, or nurse practitioner's certificate, and LA Fitness may also require that you submit to a physical examination, within 30 days of the notice of cancellation, by a doctor, physician assistant, or nurse practitioner agreeable to you and LA Fitness." We are very upset about all of this because the general manager flat out lied to us.

Now I feel forced to use their facilities in order to not feel like we were ripped off. Also, if you have a disability the underwriting of this agreement states that LA Fitness has the right to contest that notice and force us to provide LA Fitness with personal medical information?!
